Terms and Conditions
for Submitting Photographs
for the programme “Pic Me”

These terms and conditions form the full terms and conditions for submitting a/your child’s photographs/images (“Photograph(s)”) for use as Nickelodeon UK Limited (“Nick UK”) deems fit, including in the Programme “Pic Me” (“Programme”) and by submitting the Photograph(s), you agree to be bound by these terms and conditions

1. To enter a child (who must be between the ages of 9 months and 7 years) to have the chance of having their Photograph shown in an episode of the Programme, please follow the instructions given on the website (www.nickjr.co.uk/picme).

2. All Photograph(s) must be of the child’s face, taken from the front and against a plain background and must be at least 800 x 600 pixels.

3. The closing date for entries shall be as specified from time to time at www.nickjr.co.uk/picme.

4. Photographs may be submitted by UK and Eire residents only excluding employees and their families of Nick UK, its agents and any other person connected with the Programme.

5. In the event that your child’s Photograph is selected, Nick UK will endeavour to notify you by email in advance of the episode of the Programme being shown.

6. Nick UK’s decision on the selected Photograph(s) is final and no correspondence will be entered into.

7. Nick UK may use the Photograph(s) in all media throughout the world in perpetuity as Nick UK in its sole discretion deems fit, including without limitation, showing the Photograph(s) on-air, off-air and/or on the web. However, Nick UK is not obliged to use the Photograph(s) submitted.

8. Before sending in the Photograph(s) to Nick UK, if you:

a. are parent/guardian of the child, you agree to the use of your child’s Photograph as anticipated under these terms and conditions and to be bound by these terms and conditions;

b. are not the parent/guardian of the child, you agree to obtain the prior consent of the parents’/guardians’ of the child in the Photograph and the child’s parents’/guardian’s agreement to be bound by these terms and conditions.

9. Before sending in the Photograph(s) to Nick UK, you must obtain:

a. a waiver of all so-called moral rights from every person in the Photograph(s) submitted and/or creator/owner of the Photograph(s); and

b. if the Photograph(s) is/are not yours, the consent of the person, who took and/or owns the Photograph(s).

Such consents and/or waivers as required under the above and shall be in respect of (i) Nick UK’s use of the Photograph(s); and/or (ii) agreement in respect of entering into and/or granting such rights required for Nick UK’s use of the Photograph(s) as contemplated by this Agreement.

10. You further agree that all rights, titles and interests in all material and Photograph(s) submitted to Nick UK (including without limitation all artistic, literary and dramatic rights) are assigned with full title guarantee to Nick UK and shall belong to Nick UK in perpetuity. If required by Nick UK, you agree to sign such document as is or may be necessary to formalise this agreement. Notwithstanding the foregoing with respect to the materials and/or Photograph(s) submitted under these terms and conditions, Nick UK shall have the exclusive right to distribute, exhibit and exploit the materials and/or Photograph(s) submitted forever and throughout the world by any manner and means and in any and all media and service now known or in the future devised without further consent or payment.

11. You agree that you will not send to Nick UK any Photograph(s) which is/are rude, obscene, defamatory or unsuitable for children.

12. You must pay all costs in respect of sending the Photograph(s) to Nick UK. Costs to send the Photograph(s) to Nick UK, whether by post, mobile phone or the Internet, may vary so please check with either the post office (for postal costs) and/or your network operator (for mobile and/or Internet costs) for current charges.

13. If you are not responsible for paying the costs of entry, you must obtain the permission of the person paying the bill before sending your Photograph(s).

14. The Photograph(s) will not be returned.

15. No responsibility can be accepted for Photograph(s) lost, delayed, misdirected, damaged or undelivered. Nick UK shall not be responsible for any technical errors in telecommunications networks, Internet access or otherwise preventing you from sending in the Photograph(s).

16. Nick UK shall not be liable to the child, their parents’/guardian’ and/or any person in or in connection with the Photograph(s) submitted for any loss (including without limitation, loss of reputation), damage, defamation, and/or invasion of privacy howsoever caused arising out of or in connection with you submitting the Photograph(s) to Nick UK.

17. In consideration of you submitting the Photograph(s) to Nick UK, you irrevocably agree and consent to Nick UK, its successors, assignees and licensees:

(a) for the Photograph(s) to be exhibited, used and/or published by Nick UK in accordance with Paragraph 1 above and these terms and conditions;

(b) to exploit the Programme containing the Photograph(s), in whole or in part, (including, if applicable, your performance) by any and all means and in all media and formats whether known or hereafter devised throughout the world in perpetuity including without limitation cable and satellite television and websites.

18. By submitting the Photograph(s), you acknowledge that your child’s details and/or the Photograph(s) may be used without payment or further consent. Such use may include without limitation your child’s name and/or likeness, voice and/or biographical information provided by you and/or any statement made by you to Nick UK. You agree that any or all such elements may be used by Nick UK in any and all media in perpetuity throughout the world as Nick UK in its sole discretion sees fit.

19. Any personal information collected by Nick UK in connection with these terms and conditions and/or the submission of the Photograph(s) will be used in accordance with Nick UK’s Privacy Policy which can be viewed at www.nick.co.uk/global/legal/privacy.aspx or can be obtained by writing to Nick UK either by email at letterbox@nick.co.uk or by post to Nick UK’s address marked for the attention of The Data Protection Officer. If you don’t want Nick UK to use the information in this way, please tell Nick UK when entering/submitting the or at any time by writing to Nick UK as set out above.

20. These terms and conditions shall be governed by and construed in accordance with the laws of England and the courts of England shall have exclusive jurisdiction.
